Welcome to https://mysa.wine (the “Website”), operated by Pioneer Marketing, LLC d/b/a MYSA Natural Wine (“Company,” “we,” “our,” or “us”). By accessing or using this Website and related services, you agree to be bound by these Terms & Conditions (the “Agreement”). Please read carefully, as this Agreement contains important information regarding your legal rights, remedies, and obligations.

1. Eligibility & Age Requirement

  • You must be 21 years of age or older to use this Website or purchase any products.

  • By placing an order, you represent and warrant that you are at least 21 years old and that the recipient of any shipment is also at least 21 years old.

  • All alcohol deliveries require a valid government-issued photo ID upon delivery. Orders cannot be left unattended.

2. Use of Website

  • We grant you a limited, non-exclusive, revocable license to access and use the Website for personal, non-commercial purposes.

  • You may not copy, distribute, reproduce, or exploit any portion of the Website, including text, images, or intellectual property, without our prior written consent.

  • Unauthorized use of this Website or its content is strictly prohibited and may result in termination of your access.

3. Orders, Payments & Title

  • Orders placed on the Website are offers to purchase from licensed retailers that fulfill through our platform. Orders are subject to acceptance and product availability.

  • Title and ownership of all alcohol beverages passes from the licensed retailer to you, the purchaser, at the time of sale.

  • By ordering, you authorize us to arrange for transportation of alcohol on your behalf. You represent that your purchase complies with all local, state, and federal laws applicable to your location.

4. Shipping & Delivery

  • Where We Ship: We ship to most U.S. states where Direct-to-Consumer (DTC) shipping is legal. We do not ship to: Alabama, Arkansas, Illinois, Kansas, Kentucky, Maine, Rhode Island, Ohio, South Dakota, Tennessee, Utah, Wisconsin.

  • Processing Time: Orders typically process within 1–3 business days.

  • Transit Times: Shipments usually arrive within 1–5 business days after shipping, depending on carrier and destination.

  • Adult Signature Required: An adult (21+) with valid ID must sign for delivery. Customers may also elect to hold packages at a nearby secure pickup location.

  • Shipping Costs:

    • Orders over $150 ship free.

    • Wine Club orders always ship free.

    • From time to time, we may offer promotional shipping discounts.

  • Tracking: Tracking information will be sent via email once a label has been printed. Please allow up to 24 hours for tracking details to update in the carrier’s system.

5. Order Changes & Cancellations

  • Orders may be canceled if fulfillment has not yet started.

  • If fulfillment has begun at our 3PL (e.g., picking, packing, or label creation), cancellations are subject to a $20 processing/restocking fee.

  • Once an order has shipped, cancellations are no longer possible.

6. Returns & Replacements

  • Due to alcohol regulations, we cannot accept returns of products once delivered.

  • We will provide a replacement or refund in the following cases:

    • Bottles damaged or leaking upon delivery

    • Incorrect items shipped

    • Wine quality issues (e.g., corked or spoiled wine)

  • To request a replacement or refund, contact us at hello@mysa.wine within 30 days of delivery, including your order number and photos of the issue.

7. SMS/Mobile Marketing Program

By opting into our SMS program, you agree to receive recurring promotional and transactional text messages from MYSA.

  • Opt-In: Consent is required by providing your phone number via our Website form.

  • Opt-Out: Text “STOP” to unsubscribe.

  • Message/Data Rates: Standard carrier rates may apply.

  • Help: Text “HELP” or email hello@mysa.wine for support.

  • Privacy: Personal information collected for SMS communications is handled per our Privacy Policy and is not shared or sold to third parties.

  • Carriers: Service is supported on most major U.S. carriers, but availability is not guaranteed.

8. Acceptable Use

You agree not to:

  • Misrepresent your age or identity.

  • Use the Website for unlawful purposes.

  • Attempt to disrupt, hack, or interfere with the security or performance of the Website.

9. Intellectual Property

All content on this Website (including designs, text, graphics, logos, images, and other materials) is owned by or licensed to MYSA Natural Wine and protected under copyright, trademark, and other intellectual property laws. You may not use or reproduce this content without our prior written consent.

  • We do not guarantee uninterrupted or error-free service, and we disclaim all liability for delays, inaccuracies, or data loss.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Our liability is limited to the greater of (i) $10 or (ii) the total purchase price of your most recent order.

  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Website or services.

12. Governing Law & Disputes

  • These Terms are governed by the laws of the State of Massachusetts.

  • Any disputes shall first be attempted to be resolved in good faith. If unresolved, they will be submitted to binding arbitration in Massachusetts under applicable federal and state law.

  • You waive the right to a jury trial for disputes subject to arbitration.

13. Modifications

We may update these Terms at any time without prior notice. The “Effective Date” above reflects the latest revision. Continued use of the Website constitutes acceptance of any changes.

14. General Provisions

  • Language: All communications under this Agreement shall be in English.

  • Assignment: You may not assign or transfer your rights under this Agreement. We may assign our rights without restriction.

  • Severability: If any part of this Agreement is found invalid, the remaining parts will continue in full force.
